From now on, the share of Ukrainian language on national and regional channels should be at least 75%, and at least 60% on local channels.
The Draft Law No. 5313 “On Amendments to Some Laws of Ukraine Concerning the Language of Audiovisual (Electronic) Mass Media” was adopted by the Decisionof People's Representatives No. 269; the author of this Draft Law is Yuriy Krainiak, Managing Partner of Jurimex and Head of Media Law.
The Law sets the following national quotas on Ukrainian television:
- the weekly proportion of TV programs or films in the Ukrainian language in television and radio broadcasting of broadcasters of national and regional categories must not be less than 75 percent of the total duration in each of the following time intervals: between 7 am and 6 pm and between 6 pm and 10 pm;
- the weekly share of the national language in television and radio broadcasting for broadcasters of local category should be at least 60 percent of the total duration in each of the following time intervals: between 7 am and 6 pm and between 6 pm and 10 pm;
- the weekly share of the national language and of indigenous languages in television and radio broadcasting for broadcasters, which are broadcasting in indigenous languages of Ukraine, regardless of the category of the broadcast should be at least 75 percent, with at least 30 percent of the national language.
The Draft Law No. 5313 defines the rules regulating the need to add subtitles in the national language for films or TV programs, the broadcast of which is allowed in a non-Ukrainian language, and the need to add scoring or dubbing in Ukrainian of films made in the territory of former USSR republics, which are neither in Russian nor in Ukrainian language, and then are dubbed in Russian.
The document developed by Yuriy Krainiak defines the following requirements for TV programs and live-to-air programs:
- the program is considered to be made in the national language, if the presenters and persons involved perform in Ukrainian;
- live-to-air programs are considered to be made in the national language, if the presenters perform in Ukrainian.
For non-performance of such requirements TV and radio broadcaster must pay a fine in the amount of 5 percent of the total amount of a license fee.
