Yuriy Krainiak, Jurimex Managing Partner delivered a speech in the second section of the Legal Forum “Civil and economic process” on the topic “Disputes over the relations in the Internet: determination of jurisdiction, proper defendant, applicable law, evidence basis”. Mr. Krainiak told about the peculiarities how to identify trespassers in the Internet and criticized policy of the Supreme Court of Ukraine.

Yuriy Krainiak proved the participants of the Forum that the principles of identifying trespassers in the Internet under the registration databases of given domain names (WhoIs.), stipulated by the Supreme Court are misleading.  

In addition, the major domain names may be registered under the false names and the owners of the website and domain registrants may be absolutely different entities. Consequently this mistake causes mistaken identification of the defendants and this definitely prevents from restoring the violated rules of a defendant.

Legal Forum is an annual event, organized by the Supreme Court of Ukraine jointly with the leading Ukrainian legal newspaper “Yuridicheskaya Praktika”. Traditionally the forum is attended by judges, representatives of the governmental bodies as well as the leasing practitioners in Ukraine.
