On October 19, 2010, amendments were adopted to the Law of Ukraine “On LicensingCertain Types of Economic Activities” regarding the abolition of the need to obtain a license for the implementation of travel agency activities, but the licensing conditions for the implementation of tour operator and travel agency activities were still in the old version approved by the general order of the State Committee on Regulatory Policy and Entrepreneurship and the Ministry of Culture and Tourism of Ukraine on September 11, 2007 and No.111 / 55.

On July 10, 2013, the Ministry of Infrastructure approved new licensing conditions for the implementation of tour operator activities (hereinafter referred to as the new licensing conditions), which determine an exhaustive list of organizational, qualifying and other special requirements mandatory for business operators engaged in tour operator activities. It must be noted that the new version does not substantially differ from the previous one and does not contain radically new provisions.

But the changes were still made and they are aimed at: Staff Requirements, a requirement for the Head of the tour operator, its branch, other separate subdivision, chief accountant, in particular, these persons cannot be occupied by a person who is prohibited from carrying out this type of economic activity or occupy management positions by a court verdict that has entered into force, having an outstanding conviction for committing mercenary crimes in this sphere. It must be admitted that, in our opinion, such a restriction is reasonable and justified.
