On August 3, 2014 the Law of Ukraine No.1622-VII “On Amendments to the Law of Ukraine “On the State Budget of Ukraine 2014” came into effect, whereof the Article 31 specifies that from August to December 2014 the inspections of enterprises, institutions and organizations is conducted by supervisory bodies only with the permit of the Cabinet of Ministers of Ukraine or by the statement of legal entity. This rule is not applied to the inspections, conducted by the State Fiscal Service.

We would like to remind that the state fiscal service (as per the clause 1 of the Regulation on the State Fiscal Service, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 236 dated May 21, 2014) – is a central executive authority, which is controlled and coordinated by the Cabinet of Ministers of Ukraine and implements state tax policy, state customs policy, state policy on administration of unified fee to general mandatory social insurance, state policy on control the breaches of tax, customs legislation as well as unified fee regulations.

Therefore, from August to December 2014 it is implemented to limit inspections of enterprises, except for “fiscal” ones. Unfortunately, regulator failed to foresee the situation with already commenced, but unfulfilled inspections. They are expected to be terminated.
