Mariia Polishchuk, Jurimex lawyer, took part in the roundtable, organized by the Antimonopoly Committee of Ukraine, headed by Yurii Terentiev, the Chairman, Mariia Nizhnil, first deputy, involving Anna Artemenko, Svitlana Panaiotidi, authorized government officials, Viktor Talakh, Head of Competition Policy etc.
The event was devoted to the discussion of disputable issues of interpretations regarding application of the provisions of part 2 and 5 of the article 52 of the Law of Ukraine "On Economic Competition Protection", part 1 and 2 of the article 21 of the Law of Ukraine "On Protection Against Unfair Competition", approved by the Committee on July 21, 2015.
Vivid discussion was produced by the key issues, such as the legal status of the document, duration, within the economic scale of infringements. In addition, the representative of law firms and business association found important not only an imposition of a maximum margin of the penalty but also a minimum one. This will ensure the economic entities with the more effective measures of protection from infringements. Not less attention was attracted by monetary expression as "from and up to" of mitigating and aggravating circumstances when calculating an amount of the penalty. However, the representatives of the Antimonopoly Committee expressed the need to retain discretion in determining the final amount of penalties not to allow the infringers to include it in "the cost sheets" of the offense or impose on the consumer.
A development of the judicial practice in competition law and the necessity to improve appropriate regulations was also included in the agenda.Yurii Terentiev informed that the final version of the document will have been drafted and adopted till 15 of September 2015.
