Jurimex sent the State Service of Intellectual Property and State Service on Regulatory Policy and Development of Entrepreneurship the remarks and offers to the draft Law “On Amendments to Some Regulations on Copyright and Related Right Protection in the Internet”, brought up for consideration.

Draft law proposes to grant the right to block addresses in the Internet, where the content, breaching the copyright and related right is placed, to providers and telecommunications operators.

Entirely supporting the purpose of the draft law to establish effective mechanism against violations of rights and interests in the Internet, Jurimex lawyers do not separate general and non-specific approach to determine basis for blocking and the relevant procedure. Categories, suggested by the authors appear to be evaluative and providing a platform for an abuse, embezzlements to freedom of speech and access to information.

Certainly the draft law is subject to elaboration and maximally considered evaluation of that how the proposed advantages of its adoption shall cover the risks it causes. In addition not only the copyright and related rights matters should be taken into account, but exiting social and political realia in our country as well, in particular in the sphere of freedom of speech and access to information.
